I was in a traffic accident a couple of weeks ago, and it was my fault, but I’m wondering about the severity of the traffic ticket I received. It requires me to go to traffic court because an accident was involved. So here’s the story…the other driver had their left turn signal on for over half a mile. After this half mile, they began to pull to the right. As they were about halfway on the shoulder of the road, I decided to go around them and give them a lot of space because I wasn’t sure what they were doing. As I was about halfway around them, they decided they wanted to turn left FINALLY and t-boned my car. Of course, I was issued the citation for illegal passing. So what should I expect in court? Is the fee going to be outrageous, and should I consider making an appointment with an attorney? This is my first traffic accident and my first ticket ever. I am a pretty safe driver.

About a year ago I got in trouble for driving on a suspended license and received a Probation Before Judgement when I went to court. My license are suspended b/c of a few unpaid tickets. A few months ago I had a doctors appointment and used my fiances car to drive there and on my way home, right around the corner from my house, I hit a parked car. I panicked and instead of stopping, drove home to get my fiance and no sooner than walking through the door a police officer pulls up outside. I know how stupid and idiotic it was of me and I realize that I now have to suffer the consequences and pay for my actions. I’m being charged with a total of six different things, one of which is a ticket and the other five are must appears. They are as follows: 1. Failure of vehicle driver to stop after unattended vehicle damage accident 2. Failure of vehicle driver in accident to locate and notify owner of unattended veh of damage 3.Failure of M/V driver to furnish written ID info on unattended damaged veh. 4. Failure of veh. driver invoked by accident to give insurance policy info 5. Person driving motor veh. on hwy on suspended license 6. Driving/Attempting to drive motor veh. on hwy w/o required license and authorization.

Unfortunately with all of these charges I cannot afford to hire a paid attorney, but was able to get a public defender. I had one the last time I was in trouble and you don’t get to talk or discuss anything with them until the day of court. I guess my questions are, What are the chances of me having to serve jail time? How much time am I facing? What if anything can I do before my court date to help me avoid getting jail time? I currently am unemployed with three children and with only one income coming in, money is tight. I was hoping to be able to pay off the previous tickets that I owe so that I can get my license back before court, but I’m not sure if that will make a difference or not. I’m thinking that they may suspend my license for a while anyway. I am petrified of going to jail and the possibility that my children may be without me. Well I hope I didn’t give you all too much info and any opinions/information would be very much appreciated. Thanks!
Also I’m curious as to what happens with the driving on the suspended from last year? I’m not sure I even understand what a PBJ is? I mean I never had to report to probation or see a P.O. or anything.
I have an emergency credit card that I’ll use for any fines I may receive in court on the 27th.

I was involved in an accident on Jaunuary 1 where a woman ran a red light and T- Boned me. Her car spun and also hit another car. The woman and I were both taken to the emergency room for chest pain. I have been seeing a chiropractor but my chest pain is not getting any better, a little worse actually. I have been given a week off work by my chiropractor. My partner was sitting stationary on his motorbike with his indicator on, giving way to a car coming down the road. A woman in a car behind him tried to overtake him and hit the back of his bike at 30km per hr sending him off his bike and onto her bonnet. She blew over the limit when the police breath tested her, low range drink driving. There was almost 00 damage to the motorbike, which was covered and fixed. My partner had bruising to his collarbone but was just shaken up. He was taken to hospital for observation and soon released. He has problems with his left leg and his wrists now as a result and frequently takes panadol for pain. I had a severe road accident and injury, causing in a brain surgery and head trauma. However the motor vehicle’s insurance and coverage was only 000. The Lawyer told me that a law suite has been filed in the Court. Can anyone tell me will it be a 000 claim or more than that?

I was driving in middle lane as I approached an accident on the far right with 2 patrol cars. I had a green light but stopped as there were 3 motorcylce cops coming in the oppisite direction. Two of them made a left hand turn right in front of me and the third one stopped in his left hand turn lane and waved me on. I waved back at him and proceeded through the light. Seconds later one of the patrol cars pulled me over and gave me a ticket for failure to yield to an emergency vehicle. I explained that the officer stopped and waived me on. He said the officer was telling me to stop. I was stopped and the universal sign for stop is to hold your hand out not make a big sweeping motion with your arm. The fine amount is 5 and I am sure it carries points. I have a clean driving record and would like to keep it that way. I feel like I was in a no win situation.

Should I hire an attorney to fight it or show up for the court date and plead not guilty? Anyone been though traffic court in Las Vegas. Would appreciate any advise.

I received a letter from the Pennsylvania department of transportation stating the following:

Dear Motorist:

The court of M******* county has indicated you have failed to satisfy a judgment resulting from a motor vehicle accident on 05/15/2008. Your driving privilege is hereby suspended as authorized by Section 1772 of the Vehicle Code until you satisfy the judgement.

Court #: 08*** Term: ****

Your driving privilege will not be restored until you provide proof to the Department that all motor vehicles registered in your name are covered by a motor vehicle liability insurance policy or by a program of self-insurance approved by the Department and an official certificate of satisfaction from the Prothonotary of M***** County.

This insurance information will not be accepted more than one month before the eligibility date of the restoration of your driving privilege.

The letter goes on to saying what will happen if I don’t comply with this sanction.
Now for my half.
The judgement that I was suppose to satisfy is a ,000 bill from Peco Energy Co.
In 2008 I was in a vehicle with my girlfriend at the time, it wasn’t my vehicle and I wasn’t the driver.
I was 17 at the time, didn’t have a license therefor I didn’t have insurance obviously. In the police report it states that I caused the accident putting the fault on me.
In the letter it states that I have to satisfy the judgement to regain my driving privileges.
"Your driving privilege is hereby suspended as authorized by Section 1772 of the Vehicle Code until you satisfy the judgement."

But it also states that my driving privileges will not be restored until I provide proof of insurance:

"Your driving privilege will not be restored until you provide proof to the Department that all motor vehicles registered in your name are covered by a motor vehicle liability insurance policy."

I do have proof of insurance, but I don’t have ,000.
I’m going to call Penndot tomorrow to ask them to clarify this letter for me, and I want to know what else I should ask them about it.
I will most likely get an attorney for this situation, I just want to know what I should expect out of this. So if anyone can clarify this in any way I would greatly appreciate it.

I need urgent legal advice on motor vehicle claims?

 

I was involved in a accident that was not my fault on the 1st of December 2011 with a Pucto bus, the police filed an accident report and i lodge a claim with my insurance company.

My insurance provider approved the claim but not for the full settlement cost (the car was still under finance), I thought that i would still be able to file a claim against the third party for the outstanding amout. I was told by a lawyer friend of my mothers that if i accept the amout that the insurance company is willing to pay out (which only covers 80% of the setttlement amout) i cannot claim the rest of the money from the third party. is this true??

if i cannot claim from the third party then how am i supposed to pay the rest of the money back??
